The Messenger of Allah ﷺ said, "My heirs shall not divide a single dinar. Whatever I leave behind, after providing for my wives and the maintenance of my workers, is charity."
أن رسول الله ﷺ قال: لا يقتسم ورثني دنانير، ما تركت بعد نفقة نسائي ومثونة عاملي، فهو صدقة.
Malik narrated it in the Book of Speech, Backbiting, and Piety (28), from Abu Zinad, from Araj, from Abu Hurairah, who said, and then he mentioned it.Bukhari narrated it in the Book of Inheritance (6729), and Muslim in the Book of Jihad and Expeditions (1760:55), both narrating from the hadith of Malik through this chain, and in their versions it reads "a dinar," meaning whatever remains from spending on his wives and the wages of his worker is charity for the poor and needy. This is to be understood in light of ﷺ his saying in the hadith of Ayesha and others, "We leave no inheritance, whatever we leave behind is charity." That is, after the spending on his family and the wages of his worker, not before it, as indicated by the aforementioned hadith of Abu Hurairah, because charity is not permissible for the family of Muhammad ﷺ.
