Among the points Umar cited as evidence was his statement that the Messenger of Allah ﷺ had three exclusive properties, Banu Nadir, Khaybar, and Fadak.As for Banu Nadir, it was set aside for his emergency needs. As for Fadak, it was set aside for travelers in need. As for Khaybar, the Messenger of Allah ﷺ divided it into three portions, two portions distributed among the Muslims and one portion as provision for his family. Whatever remained beyond his family's provision, he allocated to the poor among the Muhajirun.
كان فيما احتج به عمر رضي الله عنها أنه قال كانت لرسول الله ﷺ ثلاث صفايا: بنو النضير وخيبروفدك، فأما بنو النضير فكانت حبسا لنوائبه، وأما فدك فكانت حبسالأبناء السبيل وأما خيبر فجزاها رسول الله ﷺ ثلاثة أجزاء: جزءين بين المسلمين وجزءا نفقة لأهله، فما فضل عن نفقة أهله جعله بين فقراء المهاجرين.
Narrated by Abu Dawud (2967), Bazzar (256), and Bayhaqi (296/6) through several routes from Usama bin Zayd, from Zuhri, from Malik bin Aws bin Hadathan, who mentioned it. Its isnad is hasan because of Usama bin Zayd, who is Laythi, for his hadith is hasan.On this subject there is also what was narrated from Amir Shaybi, who said, "The Prophet ﷺ had a share called the safi, by which he would choose, before the fifth was distributed, a male slave if he wished, a female slave if he wished, or a horse if he wished." This was narrated by Abu Dawud (2991) and Abdul-Razzaq (9485) through the route of Sufyan Thawri, from Mutarrif, from Amir Shaybi, who mentioned it. It is mursal, for Amir Shaybi was among the successors.Nasai (4145) narrated it through the route of Mahbub, from Abu Ishaq, who is Fazari, from Mutarrif, who said, "Shaybi was asked about the Prophet's share and his safi, and he said, 'As for the Prophet's ﷺ share, it was like the share of any Muslim man, but as for the share of the safi, it was a choice piece he selected from whatever he wished.'" This too is mursal.On this subject there is also what Abu Dawud (2992) narrated through several routes from Ibn Awn, who said, "I asked Muhammad about the Prophet's share and the safi. He said, 'A share was allotted to him along with the Muslims even if he was not present, and the safi was a portion taken for him from the fifth before anything else.'" This too is mursal, and Muhammad here is Ibn Sirin.There is also the mursal narration of Qatada found in Abu Dawud (2993), but its isnad contains Saeed bin Bashir, who is daif.Khattabi said, "The safi is that which he would select from the spoils, before the fifth was divided, whether a male slave, a female slave, a horse, a sword, or something else. The Prophet ﷺ was singled out with this in addition to the fifth that belonged to him personally." Maalim Sunan (230/4).
