Najdah bin Amir al-Haruri wrote to Ibn Abbas asking him about a slave and a woman who are present at the distribution of war spoils, whether they receive a share, and about the killing of children, and about the orphan, when does the status of orphanhood end for him, and about "those of kinship," who are they?Ibn Abbas said to Yazid, "Write to him. Were it not that he might fall into some folly, I would not write to him. Write,'You wrote asking me about the woman and the slave who are present at the distribution of war spoils, whether they receive any share. They receive nothing, but they may be given a token gift.You wrote asking me about the killing of children. The Messenger of Allah ﷺ did not kill them, so you must not kill them either, unless you can know about them what Musa's companion knew about the boy he killed.You wrote asking me about the orphan, when the name of orphanhood ceases from him. The name of orphanhood does not cease from him until he reaches maturity and sound judgment is recognized in him.You wrote asking me about those of kinship, who they are. We maintained that we are they, but our people refused to grant us that.'"
قال كتب نجدة بن عامر الحروري إلى ابن عباس يسأله عن العبد والمرأة يحضران المغنم، هل يقسم لهما؟ وعن قتل الولدان، وعن اليتيم متى ينقطع عنه اليتم؟ وعن ذوي القربى من هم؟ فقال ليزيد: اكتب إليه فلولا أن يقع في أحموقة ما كتبت إليه، اكتب: إنك كتبت تسألني عن المرأة والعبد يحضران المغنم، هل يقسم لهما شيء وإنه ليس لهما شيء إلا أن يحذيا، وكتبت تسألني عن قتل الولدان وأن رسول الله ﷺ لم يقتلهم وأنت فلا تقتلهم إلا أن تعلم منهم ما علم صاحب موسى من الغلام الذي قتله، وكتبت تسألني عن اليتيم متى ينقطع عنه اسم اليتم؟ وإنه لا ينقطع عنه اسم اليتم حتى يبلغ ويؤنس منه رشد، وكتبت تسألني عن ذوي القربى من هم؟ وإنا زعمنا أنا هم فأبى ذلك علينا قومنا.
