A man who had been drinking wine was brought to the Prophet ﷺ while he was at Hunayn. The Prophet ﷺ threw dust in his face, then ordered his companions to strike him with their sandals and whatever they had in their hands, until he told them, "Stop," and they stopped.When the Messenger of Allah ﷺ passed away, Abu Bakr administered forty lashes for drinking wine. Then Umar administered forty lashes during the early part of his rule. Then Uthman administered eighty lashes toward the end of his caliphate. Uthman applied both punishments, eighty and forty. Then Muawiya fixed the punishment at eighty.
أتي النبي ﷺ بشارب وهو بحنين، فحثا وجهه في التراب، ثم أمر أصحابه فضربوه بالنعال، وما كان في أيديهم. حتى قال لهم: ارفعوا فرفعوا. فتوفي رسول الله ﷺ ثم جلد أبو بكر في الخمر أربعين، ثم جلد عمر أربعين صدرا من إمارته، ثم جلد عثمان ثمانين في آخر خلافته، ثم جلد عثمان الحدين كليهما: ثمانين وأربعين. ثم أثبت معاوية الحد ثمانين.
Abu Dawud (4488) narrated it from Ibn Sarh, who is Ahmad bin Amr bin Sarh, who said, "I found in the book of my maternal uncle Abdul-Rahman bin Abdul-Hameed, from Aqeel, that Ibn Shihab told him, from Abdullah bin Abdul-Rahman bin Azhar, who told him from his father," and then he related the hadith. Nasai also narrated it by this route in al-Kubra (5283) up to his words, "Then the Messenger of Allah ﷺ passed away, and that was the practice." Abdullah bin Abdul-Rahman bin Azhar was not deemed reliable by anyone except Ibn Hibban. This is why Hafiz said of him, "Acceptable," meaning when corroborated, and indeed he has been corroborated.Abu Dawud (4487) narrated it by another route, from Usama bin Zayd, from Ibn Shihab, from Abdul-Rahman bin Azhar, who said, and then related it. Likewise, Nasai narrated it in al-Kubra through many routes from Abdul-Rahman bin Azhar, relating it in condensed form. Abu Dawud said, "Aqeel bin Khalid inserted between Zuhri and Azhar, in this hadith, Abdullah bin Abdul-Rahman bin Azhar, from his father."On this subject there is also what was narrated from Ibn Abbas, that the Messenger of Allah ﷺ did not fix a set punishment for wine drinking. Ibn Abbas said, "A man drank and became intoxicated, and he was found staggering along the path. So he was taken to the Prophet, and when he passed by the house of Abbas, he broke free and went in to Abbas and clung to him. This was mentioned to the Prophet, and he laughed and said, 'Did he do that?' and he did not order anything be done about it."Abu Dawud (4476) narrated it from Hasan bin Ali and Muhammad bin Muthanna, who both said, "Abu Asim told us, from Ibn Jurayj, from Muhammad bin Ali bin Rakana, from Ikrima, from Ibn Abbas," and then related it. Abu Dawud said, "This is among what the people of Madinah narrated alone, that is, this hadith of Hasan bin Ali." Muhammad bin Ali bin Rakana is Muhammad bin Ali bin Yazid bin Rakana. Two narrators reported from him, and no one deemed him reliable except Ibn Hibban, so he is "acceptable" when corroborated. I have not found any corroboration for him.
