The Messenger of Allah ﷺ said, "Whoever you find committing the act of the people of Lut, kill both the one who does it and the one to whom it is done."
قال رسول الله ﷺ: من وجدتموه يعمل عمل قوم لوط فاقتلوا الفاعل والمفعول به.
It was narrated by Abu Dawud (4462), Tirmidhi (1456), Ibn Majah (2561), Ibn Jarud (820), Ahmad (2732), Hakim (4/355), and Bayhaqi (8/232), all of them from the hadith of Amr bin Abu Amr, from Ikrima, from Ibn Abbas, and he related it. Hakim added the mention of intercourse with an animal, as will be mentioned later, and he said, "Sahih in isnad." Abu Dawud said, "Sulayman bin Bilal narrated it from Amr bin Abu Amr similarly, and Abbad bin Mansur narrated it from Ikrima, from Ibn Abbas, as a raised report, and Ibn Jurayj narrated it from Ibrahim, from Dawud bin Husayn, from Ikrima, from Ibn Abbas, as a raised report."Bayhaqi (8/233) connected the hadith of Abbad bin Mansur, from Ikrima, from Ibn Abbas, and Ibn Majah (2564) connected the hadith of Ibrahim bin Ismail, from Dawud bin Husayn, from Ikrima, from Ibn Abbas. But both of them made the text of the hadith concern intercourse with an animal. What appears to be the case is that a mixing occurred between the two texts, which were narrated with a single isnad, except that one of them, namely intercourse with an animal, was narrated solely by Amr bin Abu Amr, as Tirmidhi said, and Bukhari judged it to be objectionable. As for the second text, which is the killing of both the active and passive parties in the act of the people of Lut, Amr bin Abu Amr was not alone in narrating it, as Abu Dawud said. Therefore this hadith is hasan, and the majority of the people of knowledge acted upon it.Tirmidhi said, "The people of knowledge differed concerning the punishment for one who commits the act of Lut. Some of them held that he should be stoned, whether he was married or not. This is the view of Malik, Shafii, Ahmad, and Ishaq. Some of the people of knowledge among the jurists of the Followers, including Hasan Basri, Ibrahim Nakhai, Ata bin Abu Rabah, and others, said that the punishment for one who commits the act of Lut is the same as the punishment for fornication. This is the view of Thawri and the people of Kufa."On this subject there is also what has been narrated from Abu Hurairah, from the Prophet ﷺ, who said, "Whoever commits the act of the people of Lut, stone the one on top and the one beneath, stone them both together." This was narrated by Ibn Majah (2562) and Tahawi in his Mushkil (3833), both of them from the hadith of Asim bin Umar, from Suhayl bin Abu Salih, from his father, from Abu Hurairah, and he related it. Tirmidhi said, "This is a hadith in whose isnad there is discussion, and we do not know of anyone who narrated it from Suhayl bin Abu Salih other than Asim bin Umar Umari, and Asim bin Umar is weakened in hadith on account of his memory."As for what was narrated by Hakim (4/355) from Abdul-Rahman bin Abdullah bin Umar Umari, from Suhayl bin Abu Salih, with the same isnad, it contains Abdul-Rahman bin Abdullah Umari, who is discarded, as Dhahabi said. Therefore the imams did not count this isnad as anything, even though Hakim made it a corroborating witness for the hadith of Ibn Abbas.On this subject there is also what has been narrated from Jabir bin Abdullah, who said, I heard the Messenger of Allah ﷺ say, "The thing I fear most for my nation is the act of the people of Lut." This was narrated by Tirmidhi (1457), Ibn Majah (2563), and Ahmad (15093), all of them from the hadith of Qasim bin Abdul-Wahid, from Abdullah bin Muhammad bin Aqeel, from Jabir bin Abdullah, and he related it. Qasim bin Abdul-Wahid is "acceptable," as Hafiz said in Taqrib, and I have not found anyone who corroborates him, so his hadith is weak in transmission.
