I heard the Prophet ﷺ order, regarding one who commits adultery without being married, one hundred lashes and banishment for a year.Ibn Shihab said, Urwa bin Zubayr informed me that Umar bin Khattab carried out banishment, and that practice has continued ever since.
سمعت النبي ﷺ يأمر فيمن زنى، ولم يحصن: جلد مائة وتغريب عام. قال ابن شهاب: وأخبرني عروة بن الزبير: أن عمر بن الخطاب غرب، ثم لم تزل تلك السنة.
Bukhari narrated it in the Book of Hudud (6832/6831) from Malik bin Ismail, who said, Abdul-Aziz (that is, Ibn Salama Majishun) narrated to us, Ibn Shihab informed us, from Ubaydullah bin Abdullah bin Utba, from Zayd bin Khalid Juhani, and he mentioned it.What is meant by "the Book of Allah" is the verse whose recitation was abrogated while its ruling remained, namely, "If the old man and the old woman commit zina, stone them both outright, as an exemplary punishment from Allah, and Allah is Mighty, Wise." Other explanations have also been given.As for exile, it is established that the Prophet ﷺ exiled offenders, and this was the view held by the companions of the Prophet ﷺ, including Abu Bakr, Umar, Ubayy bin Kaab, Abdullah bin Masud, Abu Dharr, and others.It was likewise reported from several jurists among the Tabiin.This is also the view of Sufyan Thawri, Malik bin Anas, Abdullah bin Mubarak, Shafii, Ahmad, Ishaq, and others.Abu Hanifa said, "No one is to be exiled, because that would enable him to commit zina, unless the ruler sees benefit in it as a disciplinary and administrative measure."
