I heard Umar bin Khattab say, "Stoning is prescribed in the Book of Allah as a due penalty upon any man or woman who commits adultery after marriage, when the evidence is established, or pregnancy occurs, or there is a confession."
سمعت عمر بن الخطاب يقول: الرجم في كتاب الله حق على من زنى من الرجال والنساء إذا أحصن، إذا قامت البينة، أو كان الحبل، أو الاعتراف.
Malik narrated it in Hudud (8) from Ibn Shihab, from Ubaydullah bin Abdullah bin Utba bin Masud, from Abdullah bin Ibn Abbas, and he related it. It is a portion of a lengthy sermon that Umar bin Khattab delivered at the end of the Hajj he performed, after he returned to Madinah. Bukhari narrated it in full in Hudud (6830) via Salih (that is, Ibn Kaysan). He also narrated a portion of it, likewise in Hudud (6829), from Ali bin Abdullah, who said, Sufyan (that is, Ibn Uyayna) told us, from Zuhri, from Ubaydullah (bin Abdullah bin Utba bin Masud), from Ibn Abbas, who said, Umar said, "I feared that time would grow long for the people until someone might say, 'We do not find stoning in the Book of Allah,' and so they would go astray by abandoning an obligation that Allah had revealed. Indeed, stoning is a rightful due upon whoever commits adultery after having been married, when proof is established, or there is pregnancy, or a confession." Sufyan said, "This is how I memorized it." "Indeed, the Messenger of Allah ﷺ stoned, and we stoned after him."This is how Bukhari narrated it from Sufyan, from Zuhri, in abridged form. Muslim narrated it in Hudud (1691:15) via Yunus, from Ibn Shihab with his chain, from Ibn Abbas, who said, Umar bin Khattab said, while sitting on the pulpit of the Messenger of Allah ﷺ, "Allah sent Muhammad ﷺ with the truth, and revealed to him the Book, and among what was revealed to him was the verse of stoning. We read it, we memorized it, and we understood it. The Messenger of Allah ﷺ carried out stoning, and we carried it out after him. So I fear that if time grows long for the people, someone might say, 'We do not find stoning in the Book of Allah,' and so they would go astray by abandoning an obligation that Allah had revealed. Stoning in the Book of Allah is indeed a rightful due upon whoever commits adultery, whether man or woman, after having been married, when proof is established, or there is pregnancy, or a confession."Then Muslim said, Abu Bakr bin Abu Shayba, Zuhayr bin Harb, and Ibn Abu Umar told us, they said, Sufyan told us, from Zuhri, with this same chain.Ibn Hajar said, "Ismaili narrated it via Jafar Firyabi, from Ali bin Abdullah, Bukhari's teacher (from Sufyan, with the same content), in which, after the words 'or a confession,' it adds, 'We also read, "The old man and the old woman, if they commit adultery, stone them both, absolutely." And the Messenger of Allah ﷺ stoned, and we stoned after him.' So the words from 'We also read' up to 'absolutely' were dropped from Bukhari's narration. Perhaps Bukhari was the one who deliberately omitted that, for Nasai narrated it in Kubra (7156) from Muhammad bin Mansur, from Sufyan, matching Jafar's narration, and then said, 'I do not know of anyone who mentioned "the old man and the old woman" in this hadith except Sufyan, and it should be considered an error on his part.'"Ibn Hajar said, "The leading scholars narrated this hadith via Malik, Yunus, Maamar, Salih bin Kaysan, Aqeel, and other memorizers, from Zuhri, and they did not mention it." End of quote.He then said, "This addition occurs in this hadith in the narration of the Muwatta, from Yahya bin Saeed, from Saeed bin Musayab, who said, When Umar returned from Hajj and arrived in Madinah, he delivered a sermon to the people, saying, 'O people, practices have been established for you, obligations have been prescribed for you, and you have been left upon a clear path.' Then he said, 'Beware lest you perish by abandoning the verse of stoning, lest someone say, "We do not find two punishments in the Book of Allah." The Messenger of Allah ﷺ indeed carried out stoning, and we carried it out. By the One in whose hand is my soul, were it not that people would say Umar has added to the Book of Allah, I would have written it with my own hand, "The old man and the old woman, if they commit adultery, stone them both," absolutely.'" Malik said, "The old man and the old woman means the previously married man and woman." End of quote. Fath al-Bari (12/143), and the hadith is in the Muwatta in Hudud (10).Some scholars of verification hold that the words of Allah Most High, "The adulteress and the adulterer, flog each of them" [Nur 24:2] are general, covering both the married and the unmarried, and that in the case of the married person it was abrogated by stoning, since the Messenger of Allah ﷺ carried out stoning. This would mean that the Book was abrogated by definitive practical sunnah. They said this is preferable to claiming that the abrogating text is the words of Allah Most High, "And the old man and the old woman...", since there is no certainty that this was established as Quran, after which its recitation was abrogated while its ruling remained. This is why Ali bin Abu Talib said, "I flogged them by the Book of Allah, and I stoned them by the sunnah of the Messenger of Allah ﷺ," without attributing it to Quran whose recitation had been abrogated.On this basis, stoning would be a ruling added beyond the Book of Allah in the case of the married person, since one of the conditions for something to be Quran is that it be established through definitive, uninterrupted transmission. This is why Zayd bin Thabit hesitated to write "The old man and the old woman, if they commit adultery, stone them both, absolutely" in the Quranic text, because he was not certain that what he had heard from the Messenger of Allah ﷺ was Quran that must be recorded in the Quranic text, as will appear in the hadith that follows.
