A boy was murdered in secret, so Umar said, "If all the people of Sanaa had taken part in it, I would have executed them all."
أن غلاما قتل غيلة، فقال عمر: لو اشترك فيها أهل صنعاء لقتلتهم.
Bukhari narrated it in "Diyat" (6896) and said, "Ibn Bashar told me, Yahya narrated to us, from Ubaydullah, from Nafi, from Ibn Umar," who said what has already been mentioned. Then Bukhari said, "Mughira bin Hakeem said, from his father, that four people killed a boy, and Umar ruled the same."Ibn Bashar is Muhammad bin Bashshar, Abu Bakr Basri, whose nickname was Bundar, and he was one of Bukhari's teachers.The jurisprudence of these chapters:1- A man being put to death in retaliation for killing a woman, which is the view of the majority.2- The permissibility of naming those accused and presenting them to the murder victim (before his death) one by one.3- An adult being put to death in retaliation for killing a minor, because "jariyah" (girl) is a term for a female who has not yet reached puberty, just as "ghulam" (boy) is for a male.4- Whoever kills with a particular means is killed by that same means. This is the view of the majority, based on the words of Allah Most High, "and wounds are subject to retaliation" [Maidah 5:45]. The essence of retaliation is equivalence in the act. The people of Kufa disagreed with them, saying, "There is no retribution except by the sword." But this hadith has not been established, as noted earlier, except that the practice rests on this principle after the Prophet ﷺ forbade mutilation.
