Two men from the Ansar came to the Messenger of Allah ﷺ disputing over an inheritance between them whose details had become obscure with time, and they had no clear evidence to support their claims.The Prophet ﷺ said, "You bring your disputes to me, and I am only a human being. Perhaps one of you is more eloquent in presenting his case than the other, so I rule in his favor based on what I hear. Whoever I grant something that rightfully belongs to his brother, let him not take it, for I am only granting him a piece of the Fire, which he will carry as a brand around his neck on the Day of Resurrection."At this, both men wept, and each one said, "My right belongs to my brother."The Messenger of Allah ﷺ then said, "Since you have done this, go and divide the inheritance, striving to be fair, then draw lots, and let each of you absolve the other of any remaining claim."
جاء رجلان من الأنصار إلى رسول الله ﷺ يختصمان في مواريث بينهما قد درست ليس بينهما بينة، فقال النبي ﷺ: إنكم تختصمون إلي، وإنما أنا بشر، ولعل بعضكم أن يكون ألحن بحجته من بعض، وإنما أقضي بينكم على نحو ما أسمع منكم، فمن قضيت له من أخيه شيئا فلا يأخذه، فإنما أقطع له قطعة من النار، يأتي به إسطاما في عنقه يوم القيامة، قال: فبكى الرجلان، وقال كل واحد منهما: حقي لأخي، فقال رسول الله ﷺ: أما إذ فعلتما هذا، فاذهبا فاقتسما وتوخيا الحق ثم استهما، ثم يتحلل كل واحد منكما صاحبه.
Abu Dawud (3584-3585), Ahmad (26717), Daraqutni (4/238-239), Hakim (4/95), Ibn Jarud (1000), Bayhaqi (10/26), and Tahawi in his Mushkil (755) all narrated it from the hadith of Usama bin Zayd, who said, Abdullah bin Rafi, the freed slave of Umm Salama, narrated to us, from Umm Salama, and he related it, the wording being Ahmad's.Hakim said, "Sahih according to the criterion of Muslim." I say, it is hasan, due to the discussion concerning Usama bin Zayd Laythi, their freed slave, though he is one whose hadith is hasan.
