I married a woman, and a black woman came to us and said, "I have nursed you both."I went to the Prophet ﷺ and said, "I have married so-and-so, daughter of so-and-so, and a black woman came to us and told me, 'I have nursed you both,' but she is lying."He turned away from me, so I came around to face him and said, "She is lying."He replied, "How can you stay with her when she has claimed that she nursed you both? Leave her."
تزوجت امرأة، فجاءتنا امرأة سوداء. فقالت: أرضعتكما. فأتيت النبي ﷺ فقلت: تزوجت فلانة بنت فلان، فجاءتنا امرأة سوداء فقالت لي: إني قد أرضعتكما، وهي كاذبة، فأعرض، فأتيته من قبل وجهه، قلت: إنها كاذبة، قال: كيف بها وقد زعمت أنها قد أرضعتكما دعها عنك.
Bukhari narrated it in the Book of Marriage (5104), from Ali bin Abdullah, who said, Ismail bin Ibrahim narrated to us, Ayub informed us, from Abdullah bin Abu Mulayka, who said, Ubayd bin Abu Maryam narrated to me, from Uqba bin Harith, who said, "I also heard it from Uqba himself, but I remember Ubayd's hadith better." He then mentioned the hadith.It is also found in Sahih Bukhari (88) through another route, from Abdullah bin Abu Mulayka, from Uqba bin Harith, that he married a daughter of Abu Ihab bin Aziz. Then a woman came to him and said, "I nursed Uqba and the girl he married." Uqba said to her, "I did not know that you had nursed me, and you never told me." So he rode to the Messenger of Allah ﷺ in Madinah and asked him about it. The Messenger of Allah ﷺ said, "How can you keep her now that it has been said?" So Uqba separated from her, and she married another husband.This clearly shows that Abdullah bin Abu Mulayka heard this hadith from Uqba bin Harith directly, just as he also heard it from Ubayd bin Abu Maryam, from Uqba bin Harith. And he remembered Ubayd's version better, as he stated. Ubayd bin Abu Maryam was from Makkah, and this is his only hadith in Sahih Bukhari, as the Hafiz stated in Fath al-Bari. The reliance here rests on Ibn Abu Mulayka's hearing it from Uqba bin Harith himself.This hadith serves as evidence for accepting the testimony of the nursing woman regarding the nursing. This is the view held by Ahmad and Ishaq, and it is also the position of Ibn Abbas, Tawus, Zuhri, Uzai, and others. They said that if she is trustworthy, her testimony is accepted along with an oath.It has been narrated from Umar bin Khattab that he was consulted about a woman who testified against a man and his wife that she had nursed both of them, and he said, "No, not unless two men testify, or one man and two women." This was narrated by Saeed bin Mansur (992), and through his route by Bayhaqi (7/463), from Hushaym, who said, Ibn Abu Layla and Hajjaj informed us, from Ikrima bin Khalid Makhzumi, that Umar bin Khattab did so, and he mentioned it. However, this is a mursal report, since Ikrima bin Khalid did not hear from Umar bin Khattab, as Imam Ahmad stated.This is also the view held by Abu Hanifa and Shafii. Shafii added that there is no harm in accepting the testimony of four women, and this is also the view of Ataa, Qatada, and Shaybi.
