Abu Amr bin Hafs bin Mughira set out with Ali bin Abu Talib to Yemen and sent word to his wife Fatimah bint Qays divorcing her with the final pronouncement remaining from her divorce. He instructed Harith bin Hisham and Ayyash bin Abu Rabia to provide her with maintenance.They said to her, "By Allah, you are not entitled to any maintenance unless you are pregnant."So she came to the Prophet ﷺ and told him what they had said.He said, "You are not entitled to maintenance."She then asked his permission to move from her residence, and he granted her permission.
أن أبا عمرو بن حفص بن المغيرة خرج مع علي بن أبي طالب إلى اليمن فأرسل إلى امرأته فاطمة بنت قيس بتطليقة كانت بقيت من طلاقها. وأمر لها الحارث بن هشام وعياش بن أبي ربيعة بنفقة فقالا لها: والله مالك نفقة إلا أن تكوني حاملا. فأتت النبي ﷺ فذكرت له قولهما، فقال: لا نفقه لك فاستأذنته في الانتقال فأذن لها.
Muslim narrated it in the Book of Divorce (41:1480) through several routes from Abdul-Razzaq, who said, Mamar informed us, from Zuhri, from Ubaydullah bin Abdullah bin Utba, and he related it.At the end of it, Marwan said, "We have not heard this hadith except from a woman. We will hold to the established practice that we found people following."When Marwan's statement reached Fatimah, she said, "Then let the Quran be the judge between us and you." Allah says, "And do not evict them from their houses" [Talaq 65:1]. She said, "This applies to a woman whose husband still has the right to take her back. But what can happen after the third divorce? So how can you say she has no right to maintenance if she is not pregnant? On what basis, then, are you keeping her confined?"
