Nafi reported,

A man came to Ibn Umar and asked him about a man who had divorced his wife three times, after which his brother married her without any prior arrangement with him, intending to make her lawful again for his brother. Was she lawful for the first husband?Ibn Umar replied, "No, unless it was a marriage of genuine desire. We used to consider this fornication during the time of the Messenger of Allah ﷺ."

Sahih

عن نافع أنه قال

جاء رجل إلى ابن عمر فسأله عن رجل طلق امرأته ثلاثا، فتزوجها أخ له من غير موامرة منه ليحلها لأخيه، هل تحل للأول؟ قال: لا إلا نكاح رغبة كنا نعد هذا سفاحا على عهد رسول الله ﷺ.
