Abdullah bin Umar divorced his wife while she was menstruating, during the lifetime of the Messenger of Allah ﷺ. Umar bin Khattab asked the Messenger of Allah ﷺ about this, and the Messenger of Allah ﷺ said, "Order him to take her back, then keep her until she becomes pure, then menstruates, then becomes pure again. After that, if he wishes, he may keep her, and if he wishes, he may divorce her before touching her. That is the waiting period during which Allah has commanded that women be divorced."
إن عبد الله بن عمر طلق امرأته وهي حائض على عهد رسول الله ﷺ. فسأل عمر بن الخطاب رسول الله ﷺ عن ذلك. فقال رسول الله ﷺ: مره، فليراجعها، ثم يمسكها حتى تطهر، تحيض، ثم تطهر، ثم إن شاء أمسك بعد وإن شاء طلق قبل أن يمس، فتلك العدة التي أمر الله أن يطلق لها النساء.
Malik narrated it in "Divorce" (53) from Nafi, with this chain. Bukhari narrated it in "Divorce" (5251), and Muslim in "Divorce" (1:1417), both through the route of Malik, with this chain, similarly.Muslim also narrated it through the route of Layth bin Saad, from Nafi, from Abdullah, that he divorced a wife of his with a single divorce while she was menstruating, so the Messenger of Allah ﷺ ordered him to take her back, then keep her until she became pure, then she would menstruate again while with him. Then he should give her time until she became pure from that menstrual period, and if he wished to divorce her he should divorce her when she became pure, before having intercourse with her, for that is the waiting period which Allah commanded that women be divorced for.Likewise, Muslim also narrated it through the route of Ubaydullah, from Nafi, from Ibn Umar, who said, "I divorced my wife during the time of the Messenger of Allah ﷺ while she was menstruating. Umar mentioned that to the Messenger of Allah ﷺ, and he said, 'Order him to take her back, then leave her until she becomes pure, then she menstruates again, and when she becomes pure he may divorce her before having intercourse with her, or keep her, for that is the waiting period which Allah commanded that women be divorced for.'"Likewise, Ayub narrated it from Nafi, that Ibn Umar divorced his wife while she was menstruating, and Umar asked the Prophet ﷺ about it, so he ordered him to take her back, then give her time until she menstruated again, then give her time until she became pure, then divorce her before touching her, for that is the waiting period which Allah commanded that women be divorced for.Muslim narrated it.
