The Messenger of Allah ﷺ said, "The conditions most deserving to be fulfilled are those by which you have made intimate relations lawful."
قال رسول الله ﷺ: أحق الشروط أن توافوا به ما استحللتم به الفروج.
Bukhari reported it in the Chapter on Conditions (2721) and Muslim in the Chapter on Marriage (1418), both from the hadith of Yazid bin Abu Habib, from Abu Khayr, from Uqba bin Amir, who mentioned it.The scholars said, among these conditions is that if a man marries a woman on the condition that he will not remove her from her home, or that he will not take her out to another town, or something similar to that, then he must fulfill it. This is the view of Imam Ahmad, Ishaq, and Uzai, and it is the opinion of Umar bin Khattab.Others said, the condition here applies specifically to the dower and the obligatory rights that are required by the marriage contract itself, and not to anything beyond that which the contract does not require. This is the position of Abu Hanifa, Malik, and Shafii, and it was held before them by many of the Tabiin.
