Aishah said, "I bought Barirah, but her owners stipulated that the right of guardianship would remain with them. I mentioned this to the Prophet ﷺ, and he said, 'Free her, for the right of guardianship belongs to the one who pays the price.' So I freed her."The Prophet ﷺ then called Barirah and gave her the choice regarding her husband. She said, "Even if he gave me such and such, I would not stay with him." So she chose herself.
اشتريت بريرة، فاشترط أهلها ولاءها، فذكرت ذلك للنبي ﷺ، فقال: أعتقيها؛ فإن الولاء لمن أعطى الورق. فأعتقتها، فدعاها النبي ﷺ، فخيرها من زوجها، فقالت: لو أعطاني كذا وكذا ما ثبت عنده، فاختارت نفسها.
Bukhari narrated it in the Chapter on Manumission (2536) from Uthman bin Abu Shayba, he said, Jareer narrated to us, from Mansur, from Ibrahim, from Aswad, from Ayesha, and he related it.He also narrated it in the Chapter on Inheritance Shares (6754) through the hadith of Abu Awana, from Mansur, similarly, and in it, Aswad said, "Her husband was free."Aswad's statement is disconnected (munqati), while Ibn Abbas's statement, "I saw him as a slave," is more sahih.I say, this is because he saw him, was present for the incident, and witnessed it, so his statement takes precedence over the statement of one who did not witness it. Aswad did not enter Madinah during the time of the Prophet ﷺ, as is likewise mentioned in Fath al-Bari (12/40).In a narration from Bukhari (6760), through the hadith of Sufyan, from Mansur with his chain of transmission, it states, "Patronage belongs to whoever paid the silver and undertook the favor."His saying, "undertook the favor," means he freed him.The hadith contains evidence that patronage belongs to every manumitter, whether male or female, and this is a matter of consensus.
