Ayesha, Umm Muiminin, wanted to buy a Jariya in order to set her free. Her owners said, "We will sell her to you on the condition that her right of guardianship remains with us."Ayesha mentioned this to the Messenger of Allah ﷺ, and he said, "Do not let that stop you, for the right of guardianship belongs only to the one who frees the slave."
أن عائشة أم المؤمنين أرادت أن تشتري جارية تعتقها، فقال أهلها: نبيعكها على أن ولاءها لنا. فذكرت ذلك الرسول الله ﷺ، فقال: لا يمنعنك ذلك، فإنما الولاء لمن أعتق.
Malik narrated it in al-Itq wal-Wala (18) from Nafi, from Abdullah bin Umar, and he mentioned it.Bukhari narrated it in al-Mukatab (2562), and Muslim in al-Itq (1504:5), both of them through the route of Malik, in like manner.
