The Messenger of Allah ﷺ said, "No bequest may be made to an heir. The child belongs to the marriage bed, and the adulterer gets the stone."
أن رسول الله ﷺ قال: لا تجوز وصية لوارث، والولد للفراش، وللعاهر حجر.
Ibn Adi narrated it in Al-Kamil (2/817) from Ibn Zurayh, who said, Abdul-Ala bin Hammad told us, Hammad bin Salama told us, from Habib al-Muallim, from Amr bin Shuayb, from his father, from his grandfather, and he related it. Its chain is hasan because of Amr bin Shuayb, for he is hasan al-hadith. Habib al-Muallim is Ibn Abu Qariba, Abu Muhammad al-Muallim, a Basran among the narrators accepted by the community. Ibn Adi mentioned him in Al-Kamil because Abdul-Rahman did not use to narrate it, and at the end of the hadith he said, "Habib has sound hadiths, and I hope his narration is reliable."This is not undermined by what Daraqutni (4/98) narrated through the route of Sahl bin Ammar, who said, Husayn bin Walid told us, Hammad bin Salama told us, from Habib bin Shaheed, from Amr bin Shuayb, from his father, from his grandfather, that the Prophet ﷺ said in his sermon on the Day of Sacrifice, "There is no bequest for an heir, unless the heirs consent." This is because this Sahl bin Ammar was called a liar by Hakim, and he also added to the text the words "unless the heirs consent," which is a rejected addition, and he erred in attributing the hadith to Habib bin Shaheed, when the correct attribution is to Habib al-Muallim, as already mentioned.On this subject there is also what was narrated from Jabir as a raised hadith, "There is no bequest for an heir." Daraqutni (4/97) narrated it from Ahmad bin Muhammad bin Ismail al-Adami, who said, Fadl bin Sahl told us, Ishaq bin Ibrahim al-Harawi told me, Sufyan told us, from Amr, from Jabir, and he related it. Daraqutni said, "The correct version is mursal." Perhaps his basis for this is what Abdullah bin Ali bin Madini mentioned, saying, I heard my father say, "Abu Musa al-Harawi narrated from Sufyan, from Amr, from Jabir, 'There is no bequest for an heir.' Sufyan narrated it to us from Amr as mursal," and he cast doubt on it. Dhahabi mentioned this in Al-Mizan, in the biography of Ishaq bin Ibrahim al-Harawi.Ibn Adi also narrated it from Ahmad bin Muhammad bin Sayid, from Abu Musa al-Harawi, from Ibn Uyayna, and he found fault with it because of this Ahmad, saying, "He is the brother of Yahya bin Muhammad bin Sayid, older than him, and died earlier, and he is daif."On this subject there is also what was narrated from Ibn Abbas, who said, the Messenger of Allah ﷺ said, "A bequest to an heir is not permissible, unless the heirs wish it." Abu Dawud narrated it in Al-Marasil (341), and Daraqutni (4/97), and Bayhaqi (6/263) through his route, from the hadith of Ibn Jurayj, from Ata, from Ibn Abbas, and he related it. It has two defects. The first is the tadlis of Ibn Jurayj. The second is the disconnection, for Ata, who is Ata Khurasani, never met Ibn Abbas and never saw him. Abu Dawud said this. Bayhaqi said, "It has also been narrated through another route from him, from Ikrima, from Ibn Abbas."I say, this is what Daraqutni (4/98) and Bayhaqi narrated from the hadith of Yunus bin Rashid, from Ata Khurasani, from Ikrima, from Ibn Abbas, relating the hadith in the same way. Bayhaqi said, "Ata Khurasani is not strong." Hafiz said in Al-Talkhis (3/92), "Yunus bin Rashid connected it, saying, from Ikrima, from Ibn Abbas. Daraqutni recorded it, but the well-known version is the mursal one." However, Hafiz also said, "Daraqutni narrated it through the route of Ibn Abbas with a hasan chain."I say, he means what Daraqutni (4/98) narrated from Yusuf bin Saeed, who said, Abdullah bin Rabia told us, Muhammad bin Muslim told us, from Ibn Tawus, from his father, from Ibn Abbas, who said, the Messenger of Allah ﷺ said, "There is no bequest for an heir." In it is Abdullah bin Rabia, who is unknown, no one knows who he is. This hadith from Ibn Abbas did not become well known, and this is why Zaylai did not mention it in Nasb Raya (4/404), even though he mentioned the mursal version and the connected version citing Yunus bin Rashid.On this subject there are other hadiths as well, but what I have mentioned is the soundest of them. Some scholars have counted the hadith "there is no bequest for an heir" among the mutawatir hadiths, since it is not a condition of mutawatir hadiths that every one of their routes be sahih, for the sheer multiplicity of routes for a hadith indicates that it would be impossible for it to be a fabrication.
