The Messenger of Allah ﷺ forbade the sale of the right of patronage and its gifting.
نهي رسول الله ﷺ عن بيع الولاء، وعن هبته.
Malik narrated it in Itq (20) from Abdullah bin Dinar, from Ibn Umar, as mentioned. Bukhari narrated it in Itq (2535) and in Fara'id (6756), and Muslim in Itq (1506), both through other routes from Abdullah bin Dinar. Muslim said, "All the people are dependent on Abdullah bin Dinar in this hadith." He then mentioned a group of narrators who related it from Abdullah bin Dinar, but he did not mention Malik among them, though Malik should have priority.I say, among those who related it from Abdullah bin Dinar along with Malik are Sufyan bin Uyayna, Shuba, Sufyan bin Saeed Thawri, Sulayman bin Bilal, Ismail bin Jafar, and Dahhak.As for what Ibn Majah narrated (2748) from Muhammad bin Abdul-Malik bin Abu Shawarib, who said, Yahya bin Salim Taifi told us, from Ubaydullah bin Umar, from Nafi, from Ibn Umar, who said, "The Messenger of Allah ﷺ forbade selling the right of inheritance from freeing a slave, and forbade giving it as a gift," this is an error, as noted by Abu Zura in Ilal Ibn Abu Hatim (52/2), and by Tirmidhi (1236).Tirmidhi said, "Yahya bin Salim narrated this hadith from Ubaydullah bin Umar, from Nafi, from Ibn Umar, from the Prophet ﷺ. This is a mistake, and the mistake in it belongs to Yahya bin Salim."
