The Messenger of Allah ﷺ ruled regarding the fetus of a woman from Banu Lihyan that fell stillborn that the compensation was a slave, male or female. Then the woman against whom the ruling of the slave compensation was made passed away, so the Messenger of Allah ﷺ ruled that her inheritance went to her sons and her husband, and that the blood-money was the responsibility of her paternal male relatives.
قضى رسول الله ﷺ في جنين امرأة من بني لحيان سقط ميتا بغرة: عبد أو أمة، ثم إن المرأة التي قضى عليها بالغرة توفيت، فقضى رسول الله ﷺ بأن ميراثها لبنيها وزوجها، وأن العقل على عصبتها.
Bukhari narrated it in the Book of Inheritance (6740), and Muslim in the Book of Oaths (1681:35), both from Qutayba bin Saeed, who said, "Layth narrated to us, from Ibn Shihab, from Ibn Musayab, from Abu Hurairah," and he related it.Malik narrated it in abridged form, both with a connected chain and with a disconnected chain. As for the connected chain, he narrated it from Ibn Shihab, from Abu Salama bin Abdul-Rahman bin Awf, from Abu Hurairah, in the Book of Blood Money (12), and through his route Bukhari narrated it in the Book of Medicine (5759), and Muslim in the Book of Oaths (1681).As for the disconnected chain, he narrated it from Ibn Shihab Zuhri, from Saeed bin Musayab, that the Prophet ﷺ gave a ruling concerning the fetus, and he related it.It was also narrated from Ubada bin Samit that the Prophet ﷺ ruled in favor of Hamal bin Malik Hudhali Lihyani, granting him the inheritance from his wife whom his other wife had killed. Its chain of transmission is daif. Ibn Majah narrated it (2643), and its chain includes Ishaq bin Yahya bin Walid (who is the grandson of Ubada bin Samit), who narrated it with a disconnected chain from Ubada, and he is of unknown reliability, as stated in Taqrib.
