The Messenger of Allah ﷺ was asked about fruit still hanging on the trees. He said, "Whoever, being in need, eats some with his mouth without carrying any away in a garment, there is nothing against him. But whoever takes some away with him must pay double its value as a fine and receive a punishment. And whoever steals any of it after it has been gathered into the drying place, and the amount reaches the value of a shield, his hand is to be cut off."He mentioned regarding stray camels and sheep what others have mentioned. He said, He was also asked about lost property. He said, "Whatever is found on a frequented road or in an inhabited town, announce it for a year. If its owner comes seeking it, hand it over to him. If no one comes, then it is yours. As for what is found in ruins, in such items and in buried treasure a fifth is due."
Abu Dawud (1710), Tirmidhi (1288), Nasai (4958), and Ibn Majah (2596) all narrated it from Qutayba bin Saeed, who said, "Layth narrated to us, from Ibn Ajlan, from Amr bin Shuayb, from his father, from his grandfather Abdullah bin Amr bin As," and then he related the hadith, except that Ibn Majah narrated it through another route from Walid bin Kathir, from Amr bin Shuayb. The wording given is that of Abu Dawud, while the others give it in abbreviated form. Its chain is hasan because of Amr bin Shuayb.
