A man from Hadramawt and a man from Kindah came to the Prophet ﷺ.The Hadrami said, "Messenger of Allah, this man has taken from me a piece of land that belonged to my father."The Kindi said, "It is my land, in my possession, and I cultivate it. He has no right to it."The Messenger of Allah ﷺ asked the Hadrami, "Do you have any evidence?"He replied, "No."The Prophet ﷺ said, "Then you are entitled to his oath."The Hadrami said, "Messenger of Allah, the man is wicked. He does not care what he swears upon, and he refrains from nothing."The Prophet ﷺ said, "You have nothing from him except that."The Kindi went off to swear his oath, and as he turned away, the Messenger of Allah ﷺ said, "If he swears upon another's property in order to consume it unjustly, he will surely meet Allah while Allah turns away from him."
Muslim reported it in the Book of Faith (139) through several chains from Abu Ahwas, from Simak, from Alqama bin Waail, from his father Waail bin Hajar, who related it.In another version, from Abu Awana, from Abdul-Malik bin Umayr, from Alqama bin Waail, from Waail bin Hajar, who said, "I was with the Messenger of Allah ﷺ when two men came to him disputing over a piece of land. One of them said, 'This man seized my land, O Messenger of Allah, during the pre-Islamic era.' He was Imru al-Qays bin Aabis Al-Kindi, and his opponent was Rabia bin Abdan. The Messenger of Allah said, 'Bring your proof.' He said, 'I have no proof.' He said, 'Then his oath.' He said, 'If so, he will take it away with his oath.' The Messenger of Allah said, 'You have nothing else available to you.' So when the man stood up to swear the oath, the Messenger of Allah ﷺ said, 'Whoever wrongfully seizes land will meet Allah while He is angry with him.'"The word "seized" means he overpowered and took control of it.
