The Prophet ﷺ made a contract with the people of Khaybar for half of whatever fruit or crops the land produced.
عامل النبي ﷺ خيبر بشطر ما يخرج منها من ثمر أو زرع.
Bukhari narrated it in Harth and Muzaraah (2330), and Muslim in Musaqah (1551), both from the hadith of Yahya (that is, Qattan), from Ubaydullah, who said, Nafi told me, from Ibn Umar, and he related it. The wording is Bukhari's.Tirmidhi said (1383), after transmitting the hadith through Yahya bin Saeed, "The practice among some scholars from the companions of the Prophet ﷺ and others is based on this. They saw no harm in muzaraah for a half, a third, or a quarter. Some of them chose that the seed should come from the owner of the land. This is the view of Ahmad and Ishaq. Some scholars disliked muzaraah for a third or a quarter, but saw no harm in musaqah on palm trees for a third or a quarter. This is the view of Malik and Shafii. Some of them held that no form of muzaraah is valid except by renting the land for gold and silver." This concludes the words of Tirmidhi.
