Someone asked, "Messenger of Allah, what about land in which no one has an allotted share or partnership, only neighboring property?"He replied, "The neighbor has the greater right to what is adjacent to him."
يا رسول الله، أرض ليس فيها لأحد قسم، ولا شرك إلا الجوار؟ قال: الجار أحق بسقبه.
Nasai (4703), Ibn Majah (2496), and Ahmad (19461) all narrated it from the hadith of Husayn Muallim, from Amr bin Shuayb, from Amr bin Shareed bin Suwayd, from his father Shareed bin Suwayd, who mentioned it. Its chain is hasan on account of Amr bin Shuayb, and there has been disagreement over Amr bin Shuayb, but Husayn Muallim is trustworthy, and his narration from him is sahih, and whatever contradicts it does not undermine it.Furthermore, Amr bin Shuayb has also been corroborated. Ahmad (19469), Ibn Jarud in al-Muntaqa (645), and Abdul-Razzaq (14380) all narrated it from the hadith of Abdullah bin Abdul-Rahman bin Yaala bin Kaab Thaqafi, from Amr bin Shareed, from his father, who said, the Messenger of Allah ﷺ said, "The neighbor has greater right to his saqab."Abu Naeem said, as found with Ibn Jarud, "I said to Amr, 'What is his saqab?' He said, 'The right of preemption.' I said, 'People claim it means neighborliness.' He said, 'Indeed, people do say that.'"Abdullah bin Abdul-Rahman bin Yaala has been criticized regarding his memory, but there is no harm in relying on him for corroborating narrations.Tirmidhi (3/642) said, "The hadith of Abdullah bin Abdul-Rahman Taifi, from Amr bin Shareed, from his father, from the Prophet ﷺ on this subject, is a hasan hadith. And Ibrahim bin Maysara narrated from Amr bin Shareed, from Abu Rafi, from the Prophet ﷺ, who said, 'I heard Muhammad say, both hadiths are, in my view, sahih.'" End of quote.
