A man from the Ansar informed Ata that he had kissed his wife while fasting during the time of the Messenger of Allah ﷺ. He instructed his wife to ask the Prophet ﷺ about it.The Prophet ﷺ told her, "The Messenger of Allah ﷺ himself does that."His wife reported this back to him, and he said, "The Prophet is granted dispensations in certain matters. Go back to him and tell him so."She returned to the Prophet ﷺ and said, "He said, 'The Prophet is granted dispensations in certain matters.'"The Prophet ﷺ replied, "I am the most fearful of Allah among you, and the most knowledgeable of His limits."
عن رجل من الأنصار، أن الأنصاري أخبر عطاء أنه قبل امرأته على عهد رسول الله ﷺ وهو صائم، فأمر امرأته فسألت النبي ﷺ عن ذلك، فقال النبي ﷺ: إن رسول الله ﷺ يفعل ذلك. فأخبرته امرأته فقال: إن النبي يرخص له في أشياء، فارجعي إليه، فقولي له: فرجعت إلى النبي ﷺ، فقالت: قال: إن النبي ﷺ يرخص له في أشياء؟ فقال: أنا أتقاكم الله، وأعلمكم بحدود الله.
Ahmad narrated it (23682) from Abdul-Razzaq, and it is also in his Musannaf (7412), he said, Ibn Jurayj informed us, Zayd bin Aslam informed me, from Ata bin Yasar, and he related it. Its chain of transmission is sahih. The fact that the identity of the Ansari man is unknown does not harm it, for he is a companion, and all the companions are of unimpeachable integrity.However, Malik narrated it in the Book of Fasting (14) from Ata bin Yasar, as a mursal narration. In it, the woman came to Umm Salama, the wife of the Prophet ﷺ, and mentioned that to her. Umm Salama informed her that the Messenger of Allah ﷺ used to kiss while fasting. She went back and told her husband this, which only increased his displeasure.Ibn Abdul-Barr said, "This hadith is mursal according to all the transmitters of the Muwatta from Malik." I say, whoever connected it fully with him adds knowledge, and this is accepted among the scholars of hadith.Ibn Hazm also narrated it through the route of Abdul-Razzaq in Al-Muhalla (6/306), and he used it as evidence in refuting those who claimed that kissing while fasting was a privilege exclusive to the Prophet ﷺ.
