Regarding the verse "It is not lawful for you to inherit women against their will, nor to prevent them from marrying so that you may take back part of what you have given them, unless they commit a clear indecency" [Nisa 4:19], this was because a man used to inherit the wife of his relative and would prevent her from marrying until she either died or returned her dowry to him. So Allah established a ruling concerning this and forbade it.
{لا يحل لكم أن ترثوا النساء كرها ولا تعضلوهن لتذهبوا ببعض ما ءاتيتموهن إلا أن يأتين بفاحشة مبينة} وذلك أن الرجل كان يرث امرأة ذي قرابته، فيعضلها حتى تموت أو ترد إليه صداقها، فأحكم الله عن ذلك، ونهى عن ذلك.
Abu Dawud (2090) narrated it from Ahmad bin Muhammad bin Thabit Marwazi, who said, Ali bin Husayn bin Waqid narrated to me, from his father, from Yazid Nahwi, from Ikrima, from Ibn Abbas, who said, and then he mentioned it. Its chain is hasan because of Ali bin Husayn and his father, since both of them are graded hasan in hadith.As for His saying, "unless they commit a clear indecency" [Nisa 4:19], this means fornication, meaning, if her fornication is established, then you have the right to reclaim from her the dowry you gave her.
