The Messenger of Allah ﷺ said, "An injury caused by a dumb beast carries no liability, a well carries no liability, and a mine carries no liability, but on buried treasure a fifth is due."
وقال العجماء جرحها جبار والبئر جبار والمعدن جبار وفي الركاز الخمس
This is a sahih hadith. Bukhari narrated it in volume 9, page 12, from Saeed bin Musayab and Abu Salama bin Abdul-Rahman, from Abu Hurairah, that the Messenger of Allah ﷺ said this hadith. He narrated it in the chapter of Blood Money, and in Zakat from Abdullah bin Yusuf, and in Drinking from Mahmud bin Ghaylan. Muslim narrated it in Legal Punishments from Yahya bin Yahya and Muhammad bin Rumh. Abu Dawud narrated it in Blood Money and in Land Tax from Musaddad. Tirmidhi narrated it in Rulings from Ahmad bin Mani. Nasai narrated it in Zakat from Ishaq bin Ibrahim and from Qutayba. Ibn Majah narrated it in Blood Money from Abu Bakr bin Abu Shayba, and in Rulings from Muhammad bin Maymun and Hisham bin Ammar. Malik narrated it in Muwatta, in the chapter of Blood Money, from Ibn Shihab Zuhri.The word "jarhuha" (its wound) is vocalized with a fatha on the first letter, functioning as a verbal noun. "Al-ajma" means the animal, because it does not speak. "Jubar" is with a damma on the jim, meaning waived, nothing is due for it. "The well is jubar" means there is no liability on its owner for anything that falls into it without anyone's action, if he dug it in a place where digging is permitted. "Al-madin" (the mine) is the place from which minerals come out, so if someone hires a man to work in it and he dies, there is no liability on the one who hired him.
