The Messenger of Allah ﷺ said, "A well is exempt from liability, a mine is exempt from liability, and an animal is exempt from liability. As for buried treasure, a fifth is due on it."
حدثنا هشيم حدثنا منصور وهشام عن ابن سيرين
قال رسول الله ﷺ البئر جبار والمعدن جبار والعجماء جبار وفي الركاز الخمس
Its isnad is sahih. Mansur is Ibn Zazan. Hisham is Ibn Hassan. Ibn Sirin is Muhammad. This hadith was also narrated by the compilers of the six books, as noted in al-Muntaqa 2013.Al-Jubar, with a dammah on the jim and a lightened ba, means that which goes unpunished. That is, an injury caused by these things goes unpunished, with no compensation owed for it.Al-Madin is the place from which the minerals of the earth are extracted, such as gold, silver, copper, and the like. So said Ibn Athir.Al-Ajma, Ibn Athir said, refers to an animal. It is called by this name because it does not speak, and anything unable to speak is called ajam or mustajam.Al-Rikaz, its ruling was already discussed in many hadiths, including 2871 and 6936.
