The Messenger of Allah ﷺ said, "Whoever is killed defending his property from someone seeking to take it unjustly is a martyr."
حدثنا وكيع عن سفيان عن عبد الله بن الحسن عن خاله إبراهيم بن محمد بن طلحة
قال رسول الله ﷺ من أريد ماله بغير حق فقتل دونه فهو شهيد
Its isnad is sahih. Sufyan is Thawri. Abdullah bin Hasan bin Hasan bin Ali bin Abu Talib is trustworthy and reliable, as Ibn Main said. Musab Zubayri said, "I have not seen anyone honor a person the way our scholars honored him." Waqidi said, "He was one of the devoted worshippers, and he had nobility, presence, dignity, and a forceful tongue."Ibrahim bin Muhammad bin Talha bin Ubaydullah Taymi, his reliability was established earlier at 1401. He is a trustworthy tabii. Nasai said, "He was one of the noble ones." Ibn Saad, in volume 5 page 37, in the biography of his father, said, "Muhammad bin Talha's son was Ibrahim the lame, and he was noble and resolute. Abdullah bin Zubayr appointed him over the tax revenue of Iraq." Bukhari gave his biography in al-Kabir 1/1/315-317, and Dhahabi in Tarikh Islam 4:90-91.He is described here as the maternal uncle of Abdullah bin Hasan, but this is a loose usage, for he is not actually his maternal uncle, that is, the brother of his mother, but rather his paternal uncle on his father's side through the mother, since Hasan bin Hasan bin Ali bin Abu Talib's mother was Khawla bint Manzur bin Zaban bin Sayyar Fazariyya, who was also the mother of Ibrahim bin Muhammad bin Talha. As for Abdullah bin Hasan, his mother was Fatimah bint Husayn bin Ali bin Abu Talib, that is, the daughter of his father Hasan bin Hasan bin Ali's paternal uncle. See Ibn Saad's Tabaqat (volume 5, page 37, lines 20-25, and pages 234-235), Musab's Nasab Quraysh (page 49, line 18), and Tahdhib in the biographies of Ibrahim bin Muhammad and Abdullah bin Hasan.This hadith was narrated by Abu Dawud at 4771:4 (391 Awn al-Mabud) from Musaddad, and by Nasai 2:173 from Amr bin Ali, both of them from Yahya bin Saeed from Sufyan, with this isnad, in similar wording. Nasai also narrated it from Ahmad bin Sulayman from Muawiya bin Hisham from Sufyan. Tirmidhi 2:315 narrated it from Muhammad bin Bashshar from Abu Amir Aqadi from Abdul-Aziz bin Muttalib, both of them from Abdullah bin Hasan, with this isnad, in abridged form, with the wording, "Whoever is killed defending his property is a martyr."However, in Nasai's version it appears as Muhammad bin Ibrahim bin Talha, which is an error on the part of the narrator, the correct form being Ibrahim bin Muhammad bin Talha, as stated explicitly in Tahdhib 9:12.Tirmidhi said, "The hadith of Abdullah bin Amr is hasan, and it has been narrated through more than one route." This is indeed as he said, for it has already appeared in abridged form, with the wording of Tirmidhi and Nasai, through another route at 6522, where we pointed out many of its narrations, including this one.
