Messenger of Allah, I have acquired a piece of land in Khaybar, and I have never acquired any property more precious to me than this. What do you advise?He said, "If you wish, you may retain the land itself and give its produce as charity."So he gave it as charity, with the condition that the land itself was not to be sold, gifted, or inherited. He gave its produce as charity to the poor, to guests, for the freeing of slaves, in the cause of Allah, and to the wayfarer. There was no blame on whoever administered it if he ate from it in a reasonable manner or fed a friend, without seeking to accumulate wealth from it.
حدثنا يحيى بن سعيد وإسماعيل قالا حدثنا ابن عون قال يحيى قال حدثني نافع عن ابن عمر أن
يا رسول الله إني أصبت أرضا بخيبر لم أصب شيئا قط هو أنفس عندي منه فقال إن شئت حبست أصلها وتصدقت بها قال فتصدق بها لا يباع أصلها ولا توهب ولا تورث قال فتصدق بها في الفقراء والضيف والرقاب وفي السبيل وابن السبيل لا جناح على من وليها أن يأكل بالمعروف أو يطعم صديقا غير متمول فيه
Its isnad is sahih. It has already appeared in similar form at 4608, from Ismail, that is Ibn Ulaya, alone, from Ibn Awn."Ghayr mutamawwil fih" means not making it into wealth for himself, for he is only a custodian and trustee over it. In m it reads "ghayr mumawwal fih."
