The Prophet ﷺ said, "Whoever frees his share, or his portion, or his part of a slave, if he has enough wealth to cover the slave's full value at a fair price, then the slave is fully freed. Otherwise, only the portion he owned is freed."Ayub said, Nafi sometimes included the final phrase in this hadith and sometimes did not, so I do not know whether it is part of the hadith itself or whether Nafi added it on his own, meaning the statement, "Only the portion he owned is freed."
حدثنا إسماعيل حدثنا أيوب عن نافع
عن النبي ﷺ من أعتق نصيبا أو قال شقيصا له أو قال شركا له في عبد فكان له من المال ما بلغ ثمنه بقيمة العدل فهو عتيق وإلا فقد عتق منه قال أيوب كان نافع ربما قال في هذا الحديث وربما لم يقله فلا أدري أهو في الحديث أو قاله نافع من قبله يعني قوله فقد عتق منه ما عتق
Its chain of transmission is sahih, and it is the longer version of 4591, 4589. The longer version has already passed by way of Malik, from Nafi, from Ibn Umar, 397, with this wording. Malik's narration shows that Ayub's doubt at the end of the hadith was his alone, for Malik narrated it from Nafi as a marfu narration in its entirety.Malik's narration is in the Muwatta, 2:2, but an error occurred in the printed edition of it, where "from Nafi" was omitted. This is a printing error, and it should be corrected from the sahih manuscript of the Muwatta that I have, which is the copy of Yahya bin Yahya Madani from the past century, which he himself collated. It should also be corrected from the commentary of Zurqani, 3:247, and from Ahmad's narration to which we referred, 397.Here, in the two original copies, at the end of the hadith, before the word "Ayub," the phrase "otherwise it has already been freed of it" appears with the words "he did not free" omitted, which are established at the end of Ayub's statement. This addition is found in the margin of manuscript K, and I believe it to be a clarification from the copyist, since no mark of correctness was written over it. For that reason I did not establish it in the main text.
