Najdah wrote to Ibn Abbas asking him about five matters. Ibn Abbas said, "People claim that Ibn Abbas corresponds with the Haruriyyah. Were it not that I fear concealing knowledge I possess, I would not have written back to him."Najdah had written to him, "To proceed. Inform me whether the Messenger of Allah ﷺ used to take women on military expeditions with him, whether he allotted them a share of the spoils, whether he killed children, when the orphan's status of orphanhood ends, and inform me about the fifth, to whom does it belong?"Ibn Abbas wrote back to him, "The Messenger of Allah ﷺ did indeed take women with him on military expeditions, where they would tend to the wounded, but he did not allot them a regular share. Rather, he would give them a token portion from the spoils. The Messenger of Allah ﷺ did not kill children, so do not kill children unless you can know about a child what Khidr knew about the child he killed, so that you would kill the disbeliever and leave the believer.You wrote asking me about the orphan's orphanhood, when it ends. By my life, a man's beard may grow while he is still weak in handling his own affairs. But once he is able to manage his own affairs in the sound manner that other people do, then his orphanhood has ended.As for the fifth, we used to hold the view that it belonged to us, but our people refused to grant us that."
حدثنا محمد بن ميمون الزعفراني قال حدثني جعفر عن أبيه
كتب نجدة إلى ابن عباس يسأله عن خمس خلال فقال ابن عباس إن الناس يزعمون أن ابن عباس يكاتب الحرورية ولولا أني أخاف أن أكتم علمي لم أكتب إليه كتب إليه نجدة أما بعد فأخبرني هل كان رسول الله ﷺ يغزو بالنساء معه وهل كان يضرب لهن بسهم وهل كان يقتل الصبيان ومتى ينقضي يتم اليتيم وأخبرني عن الخمس لمن هو فكتب إليه ابن عباس إن رسول الله ﷺ قد كان يغزو بالنساء معه فيداوين المرضى ولم يكن يضرب لهن بسهم ولكنه كان يحذيهن من الغنيمة وإن رسول الله ﷺ لم يكن يقتل الصبيان ولا تقتل الصبيان إلا أن تكون تعلم ما علم الخضر من الصبي الذي قتله فتقتل الكافر وتدع المؤمن وكتبت تسألني عن يتم اليتيم متى ينقضي ولعمري إن الرجل تنبت لحيته وهو ضعيف الأخذ لنفسه فإذا كان يأخذ لنفسه من صالح ما يأخذ الناس فقد ذهب اليتم وأما الخمس فإنا كنا نرى أنه لنا فأبى ذلك علينا قومنا
Its isnad is sahih. Muhammad bin Maymun al-Zafarani al-Kufi was deemed reliable by Ibn Main and Abu Dawud. As for Bukhari, he spoke ill of him, saying in al-Kabir 1/1/234, "His hadith is denounced (munkar al-hadith)." Likewise, Nasai, Daraqutni, Hakim, and Ibn Hibban judged him daif. I did not find him in al-Duafa of Bukhari, nor in al-Duafa of Nasai. Abu Zura said, "He is lenient (layyin)," and Abu Hatim said, "There is no harm in him." We give preference to the statement of Ibn Main and Abu Dawud, because Ahmad narrated from him, and he was careful about his shaykhs and verified their hadiths.Jafar is al-Sadiq, the son of Muhammad al-Baqir.
