The Messenger of Allah ﷺ forbade the sale of gharar.Ayub said that Yahya explained the sale of gharar, saying, "Among the forms of gharar is the diver's catch, meaning whatever a diver brings up in a single dive. The sale of gharar also includes the sale of a runaway slave, the sale of a stray camel, the sale of what is in the wombs of livestock, the sale of the dirt of mines, and the sale of what is in the udders of livestock unless it is measured."
Its chain of transmission is daif. Ayub bin Utba, Abu Yahya, the judge of Yamama. Bukhari said in al-Kabir 1/1/320, "He is considered weak by them." He said the same in al-Sagheer 216, and in al-Duafa. In al-Tahdheeb, Tirmidhi is quoted as saying, on the authority of Bukhari, "He is very daif, I do not narrate from him. He did not know the sahih of his hadith from the flawed." Ahmad weakened him in his narration, and in another place said, "He is trustworthy, except that he does not properly transmit the hadith of Yahya bin Abu Kathir."He has no report in the six books except this one hadith, found in Ibn Majah 2:10. The prohibition against the sale of gharar is established in the Sahihayn and other collections through the hadith of Abu Hurairah, as noted in al-Muntaqa 2788. Azhari said, "Gharar is that which carries no guarantee and no assurance, and it includes transactions whose true nature is not fully grasped by both parties, involving anything unknown." This is taken from al-Nihaya.
