The Messenger of Allah ﷺ sent me to collect the zakat from the people of Yemen. He instructed me to take from cattle one tabi for every thirty head. Harun explained that a tabi is a one-year-old male or female calf. And for every forty head, I was to take a musinnah, a fully mature cow.The people offered to give me cattle from the herds numbering between forty and sixty, and between sixty and seventy, and between eighty and ninety. Harun said the offer concerned what fell between forty or fifty and sixty and seventy, and between eighty and ninety. I refused and told them, "Not until I ask the Messenger of Allah ﷺ about this."So I went back and informed the Prophet ﷺ, and he instructed me to take from every thirty a tabi, from every forty a musinnah, from sixty two tabis, from seventy a musinnah and a tabi, from eighty two musinnahs, from ninety three tabis, from one hundred a musinnah and two tabis, from one hundred and ten two musinnahs and a tabi, and from one hundred and twenty three musinnahs or four tabis.He said the Messenger of Allah ﷺ instructed me not to take anything from what falls between these amounts. Harun's wording was "anything from what falls between these," unless the count reached a full musinnah or a tabi. He maintained that the in-between numbers carry no zakat obligation.
حدثنا معاوية بن عمرو وهارون بن معروف قالا ثنا عبد الله بن وهب قال هارون في حديثه قال وقال حيوة عن ابن أبي حبيب وقال معاوية عن حيوة عن يزيد عن سلمة بن أسامة عن يحيى بن الحكم أن
بعثني رسول الله ﷺ أصدق أهل اليمن وأمرني أن آخذ من البقر من كل ثلاثين تبيعا قال هارون والتبيع الجذع أو الجذعة ومن كل أربعين مسنة قال فعرضوا علي أن آخذ من الأربعين قال هارون ما بين الأربعين أو الخمسين وبين الستين والسبعين وما بين الثمانين والتسعين فأبيت ذاك وقلت لهم حتى أسأل رسول الله ﷺ عن ذلك فقدمت فأخبرت النبي ﷺ فأمرني أن آخذ من كل ثلاثين تبيعا ومن كل أربعين مسنة ومن الستين تبيعين ومن السبعين مسنة وتبيعا ومن الثمانين مسنتين ومن التسعين ثلاثة أتباع ومن المائة مسنة وتبيعين ومن العشرة والمائة مسنتين وتبيعا ومن العشرين ومائة ثلاث مسنات أو أربعة أتباع قال وأمرني رسول الله ﷺ أن لا آخذ فيما بين ذلك وقال هارون فيما بين ذلك شيئا إلا أن يبلغ مسنة أو جذعا وزعم أن الأوقاص لا فريضة فيها
