The Messenger of Allah ﷺ said, "If a man's belongings are stolen or lost and he finds them in the possession of a particular man, he has the greater right to them, and the buyer may then claim back the price from the seller."
حدثنا أبو معاوية عن حجاج عن سعيد بن عبيد بن زيد بن عقبة عن أبيه
قال رسول الله ﷺ إذا سرق من الرجل متاع أو ضاع له متاع فوجده بيد رجل بعينه فهو أحق به ويرجع المشتري على البائع بالثمن
Its isnad is hasan due to Hajjaj bin Artah, and the hadith with this wording was narrated by Abu Dawud 3/287, no. 3531, in the chapter on hiring, concerning a man who finds his own property, and by Nasai 7/314, in the chapter on business transactions. Hakim graded it sahih 2/36, but Dhahabi disagreed with him regarding a man named Usayd. He is not among the narrators of Ahmad here.
