Abu Musa said, "I came from Yemen, and the Prophet ﷺ asked me, 'With what intention did you enter ihram?'I replied, 'With an ihram like the ihram of the Prophet ﷺ.'He asked, 'Do you have a sacrificial animal with you?'I said, 'No.'So he instructed me, and I performed tawaf around the Kaaba and walked between Safa and Marwa. Then I went to a woman from my people, who combed and washed my hair, after which I exited ihram. When the day of Tarwiyah came, I entered ihram for Hajj."Abu Musa continued, "I used to give people this same legal opinion throughout the rule of Abu Bakr and Umar, may Allah be pleased with them both. While I was standing in the market during the Hajj season, a man approached and whispered to me, 'You do not know what the Commander of the Believers has newly decided regarding the rites.'I announced, 'People, whoever we have given a fatwa to about anything, let him hold off. The Commander of the Believers is on his way to you, so follow his lead.'When Umar arrived, I asked him about it, and he said to me, 'If we take from the Book of Allah, it commands us to complete the rites in full. And if we take from the Sunnah of our Prophet ﷺ, he did not exit ihram until he had sacrificed his offering.'"
حدثنا أبو داود الحفري حدثنا سفيان عن قيس بن مسلم
قال أبو موسى قدمت من اليمن قال فقال لي النبي ﷺ بم أهللت قال قلت بإهلال كإهلال النبي ﷺ قال فقال هل معك من هدي قال قلت يعني لا قال فأمرني فطفت بالبيت وبين الصفا والمروة ثم أتيت امرأة من قومي فمشطت رأسي وغسلته ثم أحللت فلما كان يوم التروية أهللت بالحج قال فكنت أفتي الناس بذلك إمارة أبي بكر وعمر رضي الله تعالى عنهما فبينا أنا واقف في سوق الموسم إذ جاء رجل فسارني فقال إنك لا تدري ما أحدث أمير المؤمنين في شأن النسك قال قلت أيها الناس من كنا أفتيناه في شيء فليتئد فهذا أمير المؤمنين قادم عليكم فبه فأتموا قال فقال لي إن نأخذ بكتاب الله تعالى فإنه يأمر بالتمام وإن نأخذ بسنة نبينا ﷺ فإنه لم يحل حتى نحر الهدي
