A man was brought before Numan bin Bashir whose wife had given him her slave-girl as lawful for him.Numan said, "I will judge in this case with the judgment of the Messenger of Allah ﷺ. If she had made her lawful for him, I will flog him a hundred lashes, and if she had not made her lawful for him, I will stone him."He found that she had indeed made her lawful for him, so he flogged him a hundred lashes.
حدثنا يزيد أخبرنا سعيد بن أبي عروبة وأبو العلاء عن قتادة
رفع إلى النعمان بن بشير رجل أحلت له امرأته جاريتها فقال لأقضين فيها بقضية رسول الله ﷺ لئن كانت أحلتها له لأجلدنه مائة جلدة وإن لم تكن أحلتها له لأرجمنه قال فوجدها قد أحلتها له فجلده مائة
