I asked Rafi about Kira Ard. I said, "I have land that I rent out."Rafi replied, "Do not rent it out for anything, for I heard the Messenger of Allah ﷺ say, 'Whoever has land should cultivate it. If he does not cultivate it, let him give it to his brother to cultivate. If he does not do that, let him leave it.'"I said to him, "What if I leave him with my land, and he cultivates it and then sends me some of the straw?"He said, "Do not take anything from it, not even straw."I said, "I did not stipulate any condition with him. He only gave me something as a gift."He said, "Do not take anything from him."
حدثنا هاشم بن القاسم قال حدثنا عكرمة
سألت رافعا عن كراء الأرض قلت إن لي أرضا أكريها فقال رافع لا تكرها بشيء فإني سمعت رسول الله ﷺ يقول من كانت له أرض فليزرعها فإن لم يزرعها فليزرعها أخاه فإن لم يفعل فليدعها فقلت له أرأيت إن تركته وأرضي فإن زرعها ثم بعث إلي من التبن قال لا تأخذ منها شيئا ولا تبنا قلت إني لم أشارطه إنما أهدى إلي شيئا قال لا تأخذ منه شيئا
