I heard the Messenger of Allah ﷺ say, "Whoever drinks wine, flog him. If he returns to it, flog him. If he returns to it, flog him. If he returns a fourth time, kill him."
حدثنا عارم حدثنا أبو عوانة عن المغيرة عن معبد القاص عن عبد الرحمن بن عبد
سمعت رسول الله ﷺ يقول من شرب الخمر فاجلدوه فإن عاد فاجلدوه فإن عاد فاجلدوه فإن عاد الرابعة فاقتلوه
Its isnad is sahih. Arim has appeared many times before, and he is trustworthy and firmly reliable, his name being Muhammad bin Fadl Sadusi. Mughira is Ibn Miqsam Dabbi, and he is trustworthy, having appeared many times before. Mabad Al-Qass is Ibn Khalid Jadali, the attribution being to the tribe of Judaylah. Ibn Main and Ajli deemed him trustworthy, and Abu Hatim said he is truthful, and many others praised him. Abdul-Rahman bin Abdul-Qari is among the trustworthy of the Followers, and he had seen the Prophet, and this is how it appears in Tabarani.The hadith was mentioned earlier at 7748. It was also narrated by Abu Dawud, 4/164, no. 4482, and Tirmidhi, 4/48, no. 1444, who graded it sahih, but he transmitted from the scholars that it has been abrogated by consensus, and indeed it is so. It was also narrated by Hakim, 4/372, and Tabarani in Al-Kabir, 19/260, no. 846.
