I came to the Prophet ﷺ and heard him addressing the people, saying, "The hand that gives is the upper hand. Begin with your mother, your father, your sister, your brother, then those nearest to you and then those next nearest."A man said, "Messenger of Allah, these are the sons of Thalaba who attacked so-and-so."The Messenger of Allah ﷺ replied, "Indeed, no soul bears the crime of another."
حدثنا يونس قال حدثنا أبو عوانة عن الأشعث بن سليم عن أبيه
أتيت النبي ﷺ فسمعته وهو يكلم الناس يقول يد المعطي العليا أمك وأباك وأختك وأخاك ثم أدناك فأدناك قال فقال رجل يا رسول الله هؤلاء بنو ثعلبة الذين أصابوا فلانا قال فقال رسول الله ﷺ ألا لا تجني نفس على أخرى
Its isnad is sahih, its narrators are trustworthy and well known, and Ashath bin Salim is the same as Ashath bin Abu Shatha, who is mentioned frequently, and he is trustworthy, his hadith being accepted by the entire community. Abu Shatha is Salim bin Aswad bin Hanzala, who is among the trustworthy of the Successors by unanimous agreement.Haythami also graded it sahih, 6/283, saying, "Its narrators are the narrators of the Sahih." It is also found in Nasai, 8/53, number 4833, in the chapter on qasama, whether anyone is held accountable for the crime of another, and in Ibn Hibban, 406, number 1683. The hadith has already appeared in similar form at 15515.
