The Messenger of Allah ﷺ said, "Whoever is killed defending his property is a martyr, and whoever wrongfully seizes a hand-span of land will have it placed around his neck from the depths of seven earths."
Its isnad is sahih. Sufyan is Ibn Uyayna. Talha bin Abdullah bin Awf Zuhri Madani is the nephew of Abdul-Rahman bin Awf. He held the judgeship of Madinah, and he is a trustworthy successor (tabii thiqa), who died in the year 97 at the age of 72. He was one of the well-known generous and openhanded men, and he has a biographical entry in Ibn Saad, volume 5, pages 119-120.Here he has narrated this hadith directly from Saeed bin Zayd. It will come later in 1639, 1641, 1643, and 1646 that he narrates it, or narrates part of it, from Abdul-Rahman bin Amr bin Sahl from Saeed. Another hadith carrying part of this meaning will also come in 1652, which he narrates directly from Saeed. It will also come in 1642 that he went along with Abdul-Rahman bin Amr bin Sahl among a group of Quraysh regarding a complaint against Arwa bint Uways, and there he heard the hadith from Saeed bin Zayd. It appears that she came to complain about Saeed bin Zayd to Talha bin Abdullah while he was serving as judge in Madinah, so he and Abdul-Rahman both heard the hadith from Saeed. Perhaps he forgot part of its wording in the version that includes Abdul-Rahman, so he would sometimes narrate it from him and sometimes from Saeed directly.Tirmidhi related this hadith [1:266, Bulaq edition] via Abdul-Razzaq from Maamar from Zuhri from Talha bin Abdullah bin Awf from Abdul-Rahman bin Amr bin Sahl from Saeed bin Zayd. He then said, "Shuayb bin Abu Hamza likewise related this hadith from Zuhri from Talha bin Abdullah from Abdul-Rahman bin Amr bin Sahl from Saeed bin Zayd from the Prophet. And Sufyan bin Uyayna related it from Zuhri from Talha bin Abdullah from Saeed bin Zayd from the Prophet ﷺ, and Sufyan did not mention in it Abdul-Rahman bin Amr bin Sahl. This is a hasan sahih hadith."This narration and the assessment that follows it are established in the Bulaq edition of Tirmidhi, but they are not established in the manuscript I have, nor in the copy of the commentary on Tirmidhi.Nasai (2:172) and Ibn Majah (2:64) related from it only his saying, "Whoever is killed defending his property is a martyr," both of them via Sufyan from Zuhri.I then found that Bukhari related the hadith (5:74-75) via Zuhri from Talha bin Abdullah from Abdul-Rahman bin Amr from Saeed. Al-Hafiz mentioned both narrations in Fath al-Bari, and reconciled between them in the same way we have reconciled between them here, and praise be to Allah. See also Fath al-Bari at 1633, 1640, 1649, and 1653.
