A case was brought to Abdullah concerning a woman whom a man had married and then died without having specified a dowry for her and without having consummated the marriage. The people went back and forth to him about it, and he said, "I rule that she is entitled to a dowry equivalent to that of women like her, that she inherits, and that she must observe the waiting period."Then Maqil bin Sinan al-Ashjai testified that the Prophet ﷺ had given the same ruling in the case of Birwa, daughter of Washiq.
حدثنا يزيد بن هارون قال أخبرنا سفيان عن منصور عن إبراهيم
أتي عبد الله في امرأة تزوجها رجل ثم مات عنها ولم يفرض لها صداقا ولم يكن دخل بها قال فاختلفوا إليه فقال أرى لها مثل صداق نسائها ولها الميراث وعليها العدة فشهد معقل بن سنان الأشجعي أن النبي ﷺ قضى في بروع ابنة واشق بمثل ما قضى
Its isnad is sahih, its narrators are leading authorities. Sufyan is Thawri, Mansur is Ibn Mutamir, Ibrahim is Ibn Yazid Nakhai, and Alqama is Ibn Qays Nakhai. The hadith was narrated by Abu Dawud, 2/237, no. 2114, in the book of marriage, in the chapter on one who marries without specifying a dowry. Tirmidhi narrated it similarly, 3/441, no. 1145, and said, hasan sahih. Nasai narrated it, 6/122, no. 3356.
