I came to the Prophet ﷺ and mentioned several matters to him. Someone asked him, "Should I take the tenth from him?"He replied, "The tenths are taken only from the Jews and the Christians. There are no tenths upon the people of Islam."
قال حدثنا أبو نعيم حدثنا سفيان عن عطاء
أتيت النبي ﷺ فذكر له أشياء فسأله فقال أعشرها فقال إنما العشور على اليهود والنصارى وليس على أهل الإسلام عشور
Its chain is daif, also because of the weakness of Harb bin Ubaydullah Thaqafi. In the following chain he is named Harb bin Hilal Thaqafi. As for the first name, he said of him in Taqrib, "weak in hadith," and as for the second, he said in Tajil, "not well known." I think this is nothing but confusion from Ata bin Saaib, whose memory became confused toward the end of his life, as is well known among the scholars. This confirms that he confused it without doubt. See Tahzib Kamal 5/528.But despite the weakness of the hadith, it is acted upon by many jurists, indeed Tirmidhi said, "the majority of the jurists." We have previously explained his statement.
