The Prophet ﷺ forbade the sale of fruits years in advance and ordered the remission of losses caused by natural disasters.
حدثنا سفيان عن حميد الأعرج عن سليمان بن عتيق مكي
أن النبي ﷺ نهى عن بيع السنين ووضع الجوائح
Its isnad is sahih. Humayd al-Araj is Ibn Qays al-Makki, the Quran reciter. Whoever declared him daif was mistaken, for the daif narrator by this name is the Madani one. The narrator here specified that he is Makki in order to distinguish between the two.The hadith contains a difficulty, for all the source texts read, "He forbade selling fruit for years in advance and waived crop damages." If what we have done is valid, that is, placing a pause after "years in advance" and treating "waived" as a past tense verb, meaning "he commanded the waiving of crop damages," then this is its correct meaning, namely that he ordered the waiving of crop damages. But if we instead treat "waiving" as a verbal noun and connect it by a conjunction to what precedes it, that creates a serious problem, indeed it would be an error, because selling fruit for years in advance is what was forbidden. This is found in Muslim, 3/1178, number 1535, duplicate 101.As for waiving crop damages, it is something commanded, and this appears with the very same isnad in Muslim, via Sufyan's route from him, that the Prophet ﷺ commanded the waiving of crop damages, 3/1191, number 1554, in the chapter on sharecropping, "Waiving crop damages." The same is found in Nasai, 7/294, number 4626, and Ibn Majah, 2218, in the book of trade, "Selling fruit for years in advance and crop damage."
