The Messenger of Allah ﷺ established the right of pre-emption only in property that has not yet been divided. Once the boundaries have been set and the roads have been laid out, there is no pre-emption.
حدثنا عبد الرزاق أخبرنا معمر عن الزهري عن أبي سلمة بن عبد الرحمن
إنما جعل رسول الله ﷺ الشفعة في كل مال لم يقسم فإذا وقعت الحدود وصرفت الطرق فلا شفعة
Its isnad is sahih. It is found in Bukhari 3/124, in the chapter on transfers, when the debt of a deceased person is transferred to another man, and in Muslim 3/1237, number 1619, in the chapter on inheritance, whoever leaves behind wealth it goes to his heirs.
