We took captive some women from the prisoners of Awtas who had husbands, and we were reluctant to have relations with them while they still had husbands. So we asked the Prophet ﷺ, and this verse was revealed, "And forbidden to you are married women, except those whom your right hands possess" [Nisa 4:24]. He said, So we considered it lawful to have relations with them.
حدثنا عبد الرزاق حدثنا سفيان عن عثمان البتي عن أبي الخليل
أصبنا نساء من سبي أوطاس ولهن أزواج فكرهنا أن نقع عليهن ولهن أزواج فسألنا النبي ﷺ فنزلت هذه الآية {والمحصنات من النساء إلا ما ملكت أيمانكم} قال فاستحللنا بها فروجهن
Its chain of transmission is sahih. Uthman al-Batti is Ibn Muslim, the well-known jurist, and Abu Khalil is Abdullah bin Khalil.The hadith was narrated by Muslim, 2/1079, no. 1456, in the chapter on nursing, on the permissibility of having intercourse with a captive woman after her waiting period, by Abu Dawud, 2/247, no. 2155, in the chapter on marriage, on intercourse with captive women, by Tirmidhi, 3/429, no. 732, in the chapter on marriage, on what has been reported about a man who takes a slave woman captive, and by Nasai, 6/110, no. 3333.
