Two men disputed over an animal, and neither of them had evidence to support his claim. So the Prophet of Allah ﷺ ordered them to draw lots over the oath, whether they liked it or not.
حدثنا محمد بن جعفر قال حدثنا سعيد عن قتادة عن خلاس عن أبي رافع
أن رجلين تدارءا في دابة ليس لواحد منهما بينة فأمرهما نبي الله ﷺ أن يستهما على اليمين أحبا أو كرها
Its isnad is sahih. Abu Dawud reported it, 3616, in the Judgments, Two Men Making Claims Over Something, and Ibn Majah in the Rulings, Two Men Making Claims Over Merchandise, 2/780, no. 2329.His saying, "tadaraa," means they pushed against each other in dispute. This pushing back and forth may be verbal, and here it carries the meaning of contention.
