Someone asked, "Messenger of Allah, if I find a man with my wife, am I to leave him alone until I bring four witnesses?"He replied, "Yes."

Its chain of transmission is sahih, with the same chain as the preceding one. It is found in Muslim, 2/1135, no. 1498, in the chapter on lian, with the same wording. Likewise Malik has it in the Book of Judgments, in the section on the ruling concerning one who finds another man with his wife, 2/337. And with similar wording it is found in Abu Dawud, 4/181, no. 4533, in the Book of Blood Money, in the section on one who finds a man with his family.This hadith commands deliberation and restraint, while at the same time it opens a way out for anyone afflicted with such a situation to free himself from it. For if he were to kill her, people would not believe him, whereas if he pronounces lian against her, she is the one who bears the disgrace and shame. This makes it clear that the law of Allah is the best remedy for problems and the best cure for what lies in the hearts.
