Rafi bin Khadij reported that Muhaysa bin Masud and Abdullah bin Sahl set out toward Khaybar and separated among the palm trees. Abdullah bin Sahl was killed, and they suspected the Jews. His brother Abdul-Rahman bin Sahl and his two cousins Huwaysa and Muhaysa came to the Prophet ﷺ. Abdul-Rahman, who was the youngest of them, began to speak about his brother's case.The Messenger of Allah ﷺ said, "Let the eldest speak first," or he said, "Let the eldest begin."So the other two spoke about their companion's case. The Messenger of Allah ﷺ said, "Fifty of you swear an oath against one of their men, and he will be handed over to you bound."They said, "How can we swear about something we did not witness?"He said, "Then the Jews shall absolve themselves by the oaths of fifty of their men."They said, "Messenger of Allah, they are a people of disbelief."So the Messenger of Allah ﷺ paid the blood-money himself.Sahl said, "I entered an enclosure of theirs one day, and a she-camel from those camels kicked me with its leg."Hammad said, "This, or something like it."
حدثنا عبيد الله بن عمر بن ميسرة ومحمد بن عبيد المعنى قالا حدثنا حماد بن زيد عن يحيى بن سعيد عن بشير بن يسار
ورافع بن خديج أن محيصة بن مسعود وعبد الله بن سهل انطلقا قبل خيبر فتفرقا في النخل فقتل عبد الله بن سهل فاتهموا اليهود فجاء أخوه عبد الرحمن بن سهل وابنا عمه حويصة ومحيصة فأتوا النبي ﷺ فتكلم عبد الرحمن في أمر أخيه وهو أصغرهم فقال رسول الله ﷺ الكبر الكبر أو قال ليبدأ الأكبر فتكلما في أمر صاحبهما فقال رسول الله ﷺ يقسم خمسون منكم على رجل منهم فيدفع برمته قالوا أمر لم نشهده كيف نحلف قال فتبرئكم يهود بأيمان خمسين منهم قالوا يا رسول الله قوم كفار قال فوداه رسول الله ﷺ من قبله قال سهل دخلت مربدا لهم يوما فركضتني ناقة من تلك الإبل ركضة برجلها قال حماد هذا أو نحوه
Muslim narrated it in "Qasamah and Combatants, etc.," chapter on qasamah, no. 2/1669, from Ubaydullah bin Umar bin Maysara, and Bukhari narrated it in "Manners," chapter on honoring the elder, and that the elder should speak and ask first, no. 6143, from the hadith of Hammad bin Zayd, with the same wording.
