The Messenger of Allah ﷺ did not set a fixed punishment for drinking wine.Ibn Abbas reported that a man drank and became intoxicated. He was found staggering along the road, so he was taken toward the Prophet ﷺ. When he came alongside the house of Abbas, he broke free, ran inside, and clung to Abbas. This was mentioned to the Prophet ﷺ, who laughed and said, "Did he really do that?" He gave no order regarding the matter.
حدثنا الحسن بن علي ومحمد بن المثنى وهذا حديثه قالا حدثنا أبو عاصم عن ابن جريج عن محمد بن علي بن ركانة عن عكرمة
أن رسول الله ﷺ لم يقت في الخمر حدا وقال ابن عباس شرب رجل فسكر فلقي يميل في الفج فانطلق به إلى النبي ﷺ فلما حاذى بدار العباس انفلت فدخل على العباس فالتزمه فذكر ذلك للنبي ﷺ فضحك وقال أفعلها ولم يأمر فيه بشيء
[Sahih] Nasai narrated it in al-Kubra, no. 5290, from Muhammad bin Muthanna with this chain. Ibn Jurayj explicitly stated that he heard it directly there, and Hakim graded it sahih, 4/373, and Dhahabi agreed with him.
