He heard the Messenger of Allah ﷺ say, "There is no amputation for stealing fruit or palm pith."The man said, "Marwan has seized my slave and intends to cut off his hand. I would like you to walk with me to him and inform him of what you heard from the Messenger of Allah ﷺ."So Rafi bin Khadij walked with him until he came to Marwan bin Hakam.Rafi said to him, "I heard the Messenger of Allah ﷺ say, 'There is no amputation for stealing fruit or palm pith.'"So Marwan gave the order regarding the slave, and he was released.
حدثنا عبد الله بن مسلمة عن مالك بن أنس عن يحيى بن سعيد عن محمد بن يحيى بن حبان أن عبدا سرق وديا من حائط رجل فغرسه في حائط سيده فخرج صاحب الودي يلتمس وديه فوجده فاستعدى على العبد مروان بن الحكم وهو أمير المدينة يومئذ فسجن مروان العبد وأراد قطع يده فانطلق سيد العبد إلى
أنه سمع رسول الله ﷺ يقول لا قطع في ثمر ولا كثر فقال الرجل إن مروان أخذ غلامي وهو يريد قطع يده وأنا أحب أن تمشي معي إليه فتخبره بالذي سمعت من رسول الله ﷺ فمشى معه رافع بن خديج حتى أتى مروان بن الحكم فقال له رافع سمعت رسول الله ﷺ يقول لا قطع في ثمر ولا كثر فأمر مروان بالعبد فأرسل
[Sahih] Nasai narrated it in the chapter on cutting off the hand of the thief, section on what does not require amputation, hadith: 4964, from the hadith of Yahya bin Saeed Ansari, in abbreviated form, and it is also in Muwatta (Yahya): 2/839. Ibn Jarud graded it sahih, hadith: 826, as did Ibn Hibban, hadith: 1505. Some narrators added Wasi bin Habban to the chain (he is trustworthy), and this is an instance of an addition within a connected chain of transmission.
